This action at law upon contract was commenced and tried in the civil court of Milwaukee county, and appealed to the circuit court, where a new trial was had without objection or motion to dismiss the appeal from the civil court. The plaintiff recovered judgment in consequence of a directed verdict, and the appellant appeals, assigning error: (1) That the circuit court acquired no jurisdiction because the notice of appeal was not served upon the judge of the civil court.
