MEMORANDUM OPINION AND ORDER
PRATT, District Judge.
The Court has before it Defendant’s Motion for Judgment on Partial Findings. This is an action tried upon the facts without a jury. Plaintiff has presented and rested its case before the Court. The Court heard oral argument from both sides on the motion. This matter is fully submitted.
