MEMORANDUM OPINION
BECHTLE, District Judge.
Presently before the Court is a motion of defendants Penn Central Transportation Company (“Penn Central”), Robert W. Blanchette, Richard C. Bond and John H. McArthur, trustees of the property of Penn Central, for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. Jurisdiction is based upon diversity of citizenship, 28 U.S.C. § 1332(a), and the amount in controversy is alleged to exceed $10,000, exclusive of interest and costs.
