The above-entitled action is an action of trespass instituted to recover damages arising from an accident occurring on December 26, 1936. The praecipe for summons was filed December 23, 1938, and the summons was issued on that date. The summons is in the usual form, but after the words “there to answer” a blank occurs by reason of the failure to insert the name of plaintiff, Clyde Sarver.
