The only question involved in. this action is upon the power of the plaintiffs, who are the executors of Simon Richardson, deceased, to sell and convey the real estate of which he died seised, after the lapse of the period appointed by the will for the execution of the power. The testator died on the 28th day of October, 1850, and his executors offered certain of the lands whereof he died .seised, for sale at auction on the 27th day of January, 1858, which ■were struck off to the defendant for the sum of $40.50, as the purchaser thereof.
