The appellee sued the appellant in an action of assumpsit in the Circuit Court on a cause of action set up in the declaration in substance, that appellant, in consideration that appellee would, as surety, sign, execute, and deliver to appellant a promissory note of $250 theretofore made by Ole and John Severson to appellant, dated February 15, 1889, and due in one year, agreed with appellee to forthwith take from Ole Severson a chattel mortgage on the latter’s personal property, sufficient in value to secure the payment of the same note, and also one of like amount given by the same parties,…
