On January 14, 1969, plaintiffs filed a complaint in the circuit court of Kane County seeking damages for wrongful death and personal injuries arising out of a vehicular accident occurring on May 16, 1968, on U.S. Route 20 near that highway’s intersection with Naperville Road, in Cook County. The complaint alleged that the automobile occupied by plaintiffs was struck from the rear by a school bus possessed by defendant Elgin Public School District U-46 and operated by its agent, defendant Melva J.
