Plaintiff’s bill of complaint is for'specific performance, accounting, injunction and other equitable relief. The only tenable theory upon which relief was sought is that the defendant, Ella Burmeister, held certain real and personal property in trust for plaintiff and one Eula Burmeister, incident to which plaintiff asserts his right to specific performance, accounting, et cetera. Plaintiff was decreed relief of the character sought. In effect the decree so entered nullified the provisions of the will of Minnie J. Burmeister, deceased.
