I. INTRODUCTION

This cause is before the Court on the Motion to Dismiss (Doc. # 8) filed on behalf of the defendants to this action on November 20, 2003. Plaintiffs, 1 five registered voters from the State of Aabama who voted for Roy Moore (hereinafter “Moore”) when he was elected to the position of Chief Justice of the Aabama Supreme Court, filed this action pursuant to 42 U.S.C. § 1983 (hereinafter “Section 1983”) and 42 U.S.C. § 1973 (hereinafter “Section 2 of the Voting Rights Act”).
