Ramos, J.), entered June 23, 2009, which, upon the parties’ respective motions for summary judgment, granted plaintiff insurer’s (the insurer) motion for summary judgment and declared that it is not obligated to defend or indemnify defendant attorneys (the attorneys) in an underlying action for legal malpractice, unanimously modified, on the law, to deny the insurer’s motion, and otherwise affirmed, with costs.
