This cause is here on appeal on questions of law from a judgment entered upon a verdict for plaintiff in the sum of $75,000. The action was brought by the plaintiff against the defendant railroads to recover for personal injuries sustained in a collision between an automobile in which plaintiff was riding as a passenger and a train operated by the defendants. The collision occurred about 1 a. m. on August 17, 1946, at the intersection of Phillips avenue and The New York Central Railroad tracks in Toledo, Ohio.
