Appeal by the plaintiff, Benjamin L. M. Bates, from a judgment of the Supreme Court in favor of the defendants,- entered in the office of the clerk of the county of Mew York on the- 1st day of July, 1901, upon the decision of the court rendered after a trial at the Mew York Special Term, dismissing the complaint upon the merits.

The plaintiff is the lessee and proprietor-of a hotel called the “Everett House,” at the northwest corner of Fourth avenue and Seventeenth street, in the city of Mew York, and has been in possession thereof and conducting a hotel therein since the month of July, 1894. The lease under' which the plaintiff is now occupying the premises is dated May 1, 1896, for the term of ten years.
