This is a compensation snit in which there was an award in favor of the employee for permanent partial loss of the nse of an eye. There is no controversy as to the fact that the employee sustained an accident arising out of and in the course of his employment. He was totally disabled for a time and was paid compensation for total temporary disability.

He returned to work after a few months and brought this suit and recovered judgment as stated above. He was a miner and was knocked to the ground by a fall of rock or slate and his face driven against the floor of his working place. He sustained…
