This case is an appeal from the circuit court for the county of Lapeei, in chancery. The bill was filed to quiet title to the west half of the southeast quarter of section 14, township of Elba, Lapeer county, Mich. The defendant answered and claimed title under a tax deed and by adverse possession for more than the statutory period. The proofs were taken in open court, and a ■decree entered in favor of complainant, as prayed for. in her bill.

The defendant alleges as error that a bill to quiet title will not lie against a party in possession claiming ownership; ejectment being the only proper…
