THE COURT.

Petitioner appeals to this court from a judgment denying his petition for a writ of mandate. Respondent claims that petitioner is entitled to a salary of only $250 per month (three thousand dollars per year), and that petitioner is merely holding over as incumbent of a term which began in January, 1913. Petitioner claims that he is in office for a term beginning on the first Monday after the first day of January, 1917, and that therefore his salary, as established by law, is five thousand dollars per year.
