The plaintiff in error, hereinafter referred to as the defendant, was convicted in the district court of Beckham county, on a charge of assault with intent to commit rape upon the person of Anna Laura Elliott, a female under the age of 16 years, and his punishment, fixed at a term in the penitentiary for 5 years. The record was properly saved, and defendant has appealed from the judgment.

In order to determine whether or not the defendant was accorded a fair and impartial trial, it is necessary to set out in substance the testimony in the case.
