FRYE, Justice.
The primary issue here —the same issue over which the three reviewing judges of the Court of Appeals could not agree — is whether the trial court erred in denying defendant’s motion to dismiss the charge of robbery with a dangerous weapon at the close of the State’s evidence. We agree with defendant, for the reasons discussed below, that the evidence was not sufficient as a matter of law to support defendant’s conviction of robbery with a dangerous weapon.
