This is an action on a promissory note. The Circuit Judge tried the case without a jury, and rendered judgment for defendants. Plaintiffs appealed in error.
The note sued on is as follows:
“$158.00. On or before the twenty-fifth- day of December next we, or either of us, promise to pay to the order of A. T. Hossell one hundred and fifty-eight dollars, for value received.
“This January 24, 1889.
