Error from District Court, Potter County; Jas. N. Browning, Judge. Action by Mrs. Annie Hutcherson and others against the Amarillo Street Railway Company. Judgment for defendant, and plaintiffs bring error.

1Opinion of the Court

On May 19, 1913, Herschell Hutcherson, while in the employ of the Amarillo Street Railway Company, engaged in working upon a merry-go-round, used as an amusement feature by said company at Glenwood Park, was caught in the machinery of said merry-go-round and killed. This suit was instituted by Annie Hutchcherson, the widow, for herself and four children, also joined by the father and mother of the deceased, alleging in several particulars defective machinery and an unsafe place in which to work.
