This is an appeal on questions of law from a judgment of the Common Pleas Court for $15,000.00. in favor of the plaintiff ■ against the defendant. We refer to the parties as plaintiff and defendant.

The action was for damages for the wrongful death of plaintiff’s decedent, George Herman Rodenfels. The cause went to trial on issues joined on the second amended petition, the answer pf defendant and the reply. When the issues were drawn, L. D. Quick, also known as L. D.
