This is an action by the ancillary administrator, appointed in New York, of the estate of Albrecht Ostwald, deceased, against the banking partnership of Lippmann, Rosenthal & Co. 1 Plaintiff has brought this action to obtain possession of certain securities which are held on behalf of one Harry Ostwald by the defendant in its deposit account with J. P. Morgan & Co. Plaintiff claims that the securities were the property of the decedent at the time of his death, and, therefore, as ancillary administrator he ■is entitled to possession of them.
