This case is before the court by direct appeal from a judgment rendered by tbe District Court of Hot Springs County in favor of the plaintiff and respondent F. F. Tuttle, Administrator of the Estate of Calvin P. Stephens, deceased. For convenience this party will be hereinafter generally designated as the “plaintiff”, and the defendants and appellants, George B. Short, as Administrator of the Estate of Frank B.
