HUNTER, Circuit Judge

The defendant Ralph Landos appeals from his conviction in the district court of the Virgin Islands of murder in the first degree. By information, the government charged that the defendant, on April 30, 1971, in violation of 14 V.I.C. § 922(a)(1), with malice aforethought, did willfully, deliberately and with premeditation kill one Keith Stevens by shooting him with a pistol, thereby inflicting mortal wounds from which he died.
