Petition by Henry Reynolds, against James M. Stokesberry and others, for the partition of certain lands.

The court, at the request of the appellants, made the following finding:

“ That John Stokesberry, Senior, died seized of the lands in question in the year 1839, leaving John Stokes-berry, Junior, his son, and six other sons and daughters, his heirs at law; and, in the Summer of 1858, the plaintiff obtained from the said John Stokesberry, Junior, a conveyance by quitclaim deed of his interest in the said land in question.
