BROWN, Associate Justice.

Henderson sued the railroad company in the District Court of Tarrant County, to recover damages caused by defendant taking his land for the construction of its railroad, and for damages occasioned by the manner of its construction, setting up many grounds of damage. Judgment was given in the District Court for the plaintiff, from which the defendant appealed; the judgment was by the Court of Civil Appeals affirmed. The Court of Civil Appeals filed the folr lowing conclusions of fact:
