Appeal from a judgment of the Supreme Court (Sackett, J.), entered July 9, 2007 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of respondent denying petitioner’s request for parole release.

In 1986, following his convictions of murder in the second degree, two counts of criminal possession of a weapon in the third degree, criminal possession of a controlled substance in the seventh degree and possession of burglar’s tools, petitioner was sentenced to an aggregate prison term of 15 years to life.
