Defendant in error commenced suit against plaintiff in error, May 7, 1904, and, ¡November 14, 1904, filed a declaration in substance as follows:

“For that whereas the defendant, contriving and wickedly intending to injure the plaintiff and to deprive him of the society and assistance of Becky Miller, the wife of the plaintiff, to alienate and destroy her affection for the plaintiff and to disturb and break up the home and conjugal happiness of the plaintiff, did, on the-day of April, A.
