OPINION ON STATE’S PETITION FOR DISCRETIONARY REVIEW

MILLER, Judge.

Appellant was found guilty of murder by the trial court, then sentenced by that court to 45 years in the Texas Department of Criminal Justice, Institutional Division. On appeal, appellant challenged the sufficiency of the evidence and complained the trial court erred by admitting testimony of his custodial confession. The court of appeals found the evidence sufficient, but found trial court error in admitting the custodial confession.
