This appeal arises out of a dispute between a borrower and lender 1 over the disposition of proceeds from the consensual foreclosure of a deed of trust on the borrower’s eleven-unit apartment building located at 4811 Minnesota Avenue, N.E. (“4811”) in the District of Columbia. The principal issue is whether the lender can recover from the proceeds of the sale (1) the amount the lender paid to satisfy a more than $40,000 water and sewer bill on the property and (2) the attorney’s fees incurred in the foreclosure.
