This is an appeal from a judgment of the United States Customs Court overruling the protest of appellants and holding certain articles to be properly dutiable under paragraph 399 of the Tariff Act of 1922, and not under paragraph 1449 as claimed by appellants.

Upon the trial in the court below appellants abandoned a number of items covered by the protest, and in the brief of appellants certain other items are abandoned, leaving for consideration by us only the articles represented by Exhibits 1,2, and 3, each of which is a metal figure of a woman upon a marble base, each exhibit being about…
