John A. Allison sued Theodore J. Lightjiiser and Charles H. Lighthiser in the Superior Court of Baltimore City to recover a sum of money claimed by him to be due by them as co-partners, trading as T. J. Lighthiser & Company. The declaration contains the common counts' only. The two defendants pleaded separately. Charles H. Lighthiser pleaded, first, that he was never indebted as alleged; secondly, that he did not promise as alleged; and thirdly, that he had not at any time traded as co-partner with the other defendant.
