Sam Chapman was indicted for the. murder of James Brown, and the jury found him guilty of involuntary manslaughter in the commission of an unlawful act. He made a motiou for a new trial, which was overruled, and he excepts to the refusal of che court to grant a new trial. The motion for a new trial was predicated upon the grounds that the verdict was contrary to law and the evidence, and that the court erred in'giving in charge the law of voluntary and involuntary manslaughter.
