Sweeney, J.:

This is an application for a writ of prohibition to restrain the judge of the respondent court from proceeding to try the petitioner for murder or any other crime under an indictment for murder in this case. The petitioner was indicted on or about the 25th day of September, 1907, by the grand jury of Esmeralda County for the crime of murder, and on the trial thereof was convicted of involuntary manslaughter and sentenced to three years’ imprisonment in the Nevada State *532Prison.
