This action was brought to determine in what shares the parties own a bank deposit of $22,522.03, representing the undistributed proceeds of a sale of merchandise under a written contract dated May 7, 1940. The parties call the sale a joint-operation sale of merchandise. When the contract was entered into, plaintiff owned two clothing and haberdashery stores in Minneapolis, one known as the downtown, and the other as the University or campus, store.
