During August of 1998, appellant was tried by a general court-martial composed of a military judge sitting alone at Hickam Air Force Base in Hawaii. In accordance with a pretrial agreement, he pleaded guilty to wrongfully using and distributing marijuana, in violation of Article 112a, Uniform Code of Military Justice (UCMJ), 10 USC § 912a.
