BAKER, Judge.
The appellant, Manuel Villareal, Jose Carrasco and Alejo Menjarez were indicted jointly in the district court of El Paso county for murdering William Meers by shooting him with a pistol; appellant was convicted and his punishment assessed at death.
The record in this case briefly stated, shows the facts to be that the deceased, Meers, W. L. Laird, and 0. A. Bitticks and Geo. H. Reed, started from the American Trust and Savings Bank in El Paso to. near what is known as the Van Noy building with about fifteen thousand dollars with which to pay off the checks of G-. H. & S.
