This is an action to quiet title to an undivided interest in certain real property in Santa Barbara County. The defendant had judgment, and plaintiff appeals from an order denying his motion for a new trial.

The real property in question is an undivided one twelfth of what is called the Newlove Ranch. Plaintiff’s claim is that he became the owner of this under the terms of the will of his father, John Newlove, who died January 29, 1889.
