WALTHALL, Justice.

Mrs. Annie E. McLain, surviving widow of Charles M. McLain, as plaintiff, brought this suit for herself and on behalf of two surviving children of her family, naming them, against defendant, Missouri-Kansas-Texas Railroad Company of Texas, to recover damages which she alleges she and said children sustained by reason of the alleged negligent acts of defendant proximately causing the death of her said husband. The damages sued for were the sum of $12,000, and plaintiff prayed that such sum as she Inay recover be apportioned between plaintiff and her said children.
