This suit was instituted by ap-pellee, J. W. Burton, for the recovery of damages from appellant, the city of Ft. Worth, on account of the overflow and submerging of a portion of appellee’s lands lying contiguous to the West fork of the Trinity river, caused by the construction of a dam across said river about two miles south of appellee’s said lands. Said dam was erected for the purpose of constructing a reservior, known as Lake Worth, and it was alleged by plaintiff that, by reason thereof, the water which had previously drained away from ap-pellee’s said lands was caused to back up on, and…
