Knutson, Justice.

At the September 1950 primary election, James M. Youngdale, hereinafter referred to as the contestant, and Carl J. Eastvold, hereinafter referred to as the contestee, were both candidates on the Democratic-Farmer-Labor party ticket for nomination for representative in congress for the seventh congressional district. The state canvassing board found that contestant received 5,886 votes and contestee 5,938 votes.
