Stolz, Judge.
The defendant appeals from his conviction on two counts of violating the Uniform Narcotic Drug Act and from the denial of his motion for a new trial as amended. Held:
1. The trial judge did not err in overruling the defendant’s motion for a directed verdict on the grounds of the alleged insufficiency and illegality of the evidence upon which the grand jury returned the indictment, when the attacks on the indictment were made for the first time at the close of the state’s case.
