KEY, Chief Justice.

This is a suit by a former inmate of the State Lunatic Asylum at Austin, seeking to recover a judgment against B. M. Worsham for $140, which the plaintiff charges the defendant took from his person and delivered to one Mrs. Moore.

There was a jury trial, which resulted in favor of the plaintiff, and the defendant has appealed. The undisputed testimony shows that the plaintiff was adjudged insane on the 16th day of July, 1906, and was sent to the State Lunatic Asylum at Austin; that the defendant, B. M.
