This cause has been argued and submitted upon a demurrer to the petition, based upon two grounds, appearing, it is alleged,, upon the face of the petition, viz., insufficiency of the facts to justify the action, and want of jurisdiction in the court of the subject-matter of the action. The allegations of the petition, in brief, are to the effect that three persons, each of whom wras entitledto the benefits of the provisions of the act of congress providing for the sale of timber lands in the states of California, Nevada, and Oregon, and in the territory of Washington, approved June. 3, 1878,…
