Feinman, J.), entered October 1, 2012, which, to the extent appealed from as limited by the briefs, granted defendants’ motion to dismiss the fourth cause of action for quantum meruit and the eighth cause of action for unjust enrichment, unanimously modified, on the law, to reinstate the fourth and eighth causes of action against defendant Bastianich, and otherwise affirmed, without costs.
