James D. Grigsby filed a claim with the Industrial Commission on February 17, 1976, alleging that he had sustained an accidental injury arising out of and in the course of his employment by respondent, Jewel Tea Company, on July 22, 1974. After a hearing on September 6, 1976, the arbitrator awarded claimant compensation for temporary total disability and permanent partial loss of use of both legs. These awards were based on the maximum rates applicable under the workmen’s compensation statute in effect at the time of the injury (Ill. Rev. Stat. 1973, ch. 48, par. 138.8).
