Appeal by the defendant, Florence J. Maxwell, from a judgment of the County Court of Kings county in favor of the plaintiff, entered in the office of the clerk of said county on the 23d day of March, 1912, upon the decision of the court rendered after a trial before the court without a jury.

This action is brought for the foreclosure of a second mortgage, made February 16, 1910, by Frank A. Bandholtz to secure the payment of $1,500 and interest to one Elizabeth A. Bandholtz. This mortgage' was immediately assigned to the Mortgage Securities Company. Upon the trial of this action ' an assignment from said company to plaintiff was offered in evidence. This assignment, dated June 28,1910, had, not been recorded at the date of the trial., Subsequently to the making of said mortgage the premises covered thereby Were conveyed to defendant’s husband) and by him to her.
