This cause, which is trover for sundry articles alleged to be the property of the plaintiffs, comes before the court upon a statement of facts, in which it is agreed by the parties that the trustees of Dartmouth College were a body corporate, duly organized under a charter bearing date December 13, 1769 ; that the several articles mentioned in the writ were the property of that body corporate, and that before the commencement of this action the said articles being in the possession of the defendant, he refused, although duly, requested, to deliver them to the plaintiffs.
