Thompson v. State

Court of Appeals of Georgia

1Opinion of the Court

BARNES, Chief Judge.

Ralph Thompson appeals the trial court’s denial of his motion to vacate a void sentence. This appeal follows this court’s earlier affirmance of Thompson’s convictions in his initial appeal. See Thompson v. State, 237 Ga. App. 466 (517 SE2d 339) (1999). In this appeal, Thompson contends the trial court erred by denying his motion to vacate a void sentence because the trial court improperly sentenced him as a recidivist under OCGA § 17-10-7 (c). He contends the State could not prove three valid prior convictions which would authorize punishment under OCGA § 17-10-7 (c).
