PARKER, District Judge.

The subject of this Memorandum Opinion and Order of Remand is plaintiff Raymond A. Gallegos’ “Motion to Remand” (Doc No. 7), filed September 24, 1996. On January 6, 1997,1 held a hearing on the motion. James Toulouse and Brett Loveless appeared on behalf of Raymond Gallegos, who was present. Lee Bergen appeared on defendant’s behalf.
