OPINION
MOTLEY, District Judge.
Plaintiff, Betal Environmental Corporation (“Betal”), filed this labor action under section 303 of the Labor Management Relations Act (“LMRA”), 29 U.S.C. § 187, against defendant, Local Union 78, Asbestos, Lead & Hazardous Waste Laborers, affiliated with the Mason Tenders District Council of Greater New York, LIUNA, AFL-CIO (“Local 78”). Against Local 78, Betal seeks damages for activity and conduct defined as an unfair labor practice in violation of sections 8(b)(4)(B) and 8(b)(4)(D) of the LMRA, 29 U.S.C. §§ 158(b)(4)(B), 158(b)(4)(D).
